Manage Your Compliance and Establish a Reasonable Steps Defence
The Fatigue Management laws for truck operations are very complex . Breaches attract fines from $500 to $10,000 (drivers) and up to $50,000 (operators). There is a very high risk of errors and breaches if you plan schedules and allocate work manually and monitor drivers' compliance through manual record keeping and compliance checking. That's why more and more operators are adopting SAMS's innovative tools and programs to help manage compliance and - when the inevitable mistakes are made - establish a Reasonable Steps Defence. Steve Shearer, a recognised expert in the Fatigue Management and Speed Compliance laws, has developed our practical tools for operators and drivers that are suitable for Owner-Operators and small to large fleets.
If just 5% of work days in a 5-truck fleet involve breaches - that's 60 breaches in a year and the cost in fines can easily be over $30,000 and up to several hundred thousand dollars; so avoiding just a mere handful of such fines makes investing a far smaller amount in SAMS Fatigue Management and Speed Compliance tools and products.
Errors and Breaches Will Happen – BUT will Your Business be Protected?
No transport business is perfect and no driver group is error-free, so there will be Fatigue and Speed breaches. The key for your business in avoiding, or dfending, such fines is to ensure that YOU:
-
Avoid breaches – eg by planning legal schedules and monitoring drivers’ compliance; and
-
Can PROVE, with credible documented evidence, that you took All Reasonable Steps.

PRODUCT SUMMARY and COMPARISON
The Fatigue Database is our most comprehensive Fatigue Management and compliance tool. It enables you to to plan schedules, allocate work and record, assess and maintain work diary records for as many drivers and trips as you wish and to undertake complete compliance checking and monitoring - EASILY AND SIMPLY. It produces comprehensive reports of work history and compliance by driver, by depot or across your entire business.
The Fatigue Database is the best tool for any business that is serious about ensuring effective monitoring and management of its compliance with the Fatigue Management laws - and MINIMISING the Risk of Fines. The Fatigue Database is a POWERFUL REASONABLE STEPS DEFENCE TOOL.
The Fatigue Database also enables the user to record and manage drivers' Health and Medical records, Licences, Training, and compliance history. The Database handles Standard Hours, BFM and AFM, for Solo and 2-Up drivers. The system requirement is Microsoft Access 2007 or later.
The Fatigue Calculator is an excellent SNAPSHOT CHECKER for up to 14 days of Work Records or Schedules at a time for one driver at a time. It is not a databse and can only handle one driver at a time for a maximum of 14 days.
Like the Fatigue Database, the Calculator is simple to use and handles Standard Hours and BFM for Solo and 2-Up drivers. The Calculator is designed to deal purely with checking Work Diaries or Schedules and so it does not provide the far more comprehensive features of the Fatigue Database, such as the health/medical records and the licences etc and it does not produce any reports other than the Work Diary Print Out and the 14-Day Compliance Report. System Requirements. The Fatigue Calculator is ideal for random checking of drivers' Work Diary compliance. The system requirement is Microsoft Excell 2003 or later.
The Fatigue Buddy is an in-truck tool designed specifically to help the driver avoid breaches by warning the driver when they will breach the Hrs in the Prior 24hrs rule and when they must START their next Short Rest, Sleep Rest and 24Hr Rest. All the driver has to do is click a Work/Rest button when they Start a Work Period or a Rest Period - the program does the rest. The Fatigue Buddy will operate on a small laptop with Microsoft Excell 2003 or later.
Fatigue Wheel - The Fatigue Rest Rules Ready-Reckoner for Drivers and Office Staff
The Fatigue Wheels provide Drivers and office staff, with a very simple easy to use ready-reckoner for checking compliance with the Short Rest Rules. It is a laminated A5 (1/2 A4 - fits easily in a Work Diary) board with a rotating wheel that lets the user see latest times by which the Short Rests must be taken, given that work started at a specified time. Just turn the dial to align the Start Time with the red start line and then read off the Stanadrd Hrs or the BFM Hrs ring on the wheel to see when the Rest are required. This also helps drivers ensure that they don't breach the maximum Work Without Rest rule, if they take their first rest early - this is a common mistake that can cost the driver $300 to $500.
Scheduler - A Simple Tool For Issuing Detailed Schedules to Drivers - With Variable Start Times
The Scheduler is an easy to use ideal tool that lets operators set up Standard Schedules (or even one-off schedules) and then print out the Schedule for the driver in a simple format, showing the start time and location of each Rest Period and Work Period. The Schedule shows the hours involved in each leg and for the whole trip and if you enter the kms for each leg, it also displays the average speed for each leg. The Scheduler therefore provides a useful guide for the driver as well as evidence that you met your Scheduler's Duty of Care under the Fatigue and Speed laws - at least for the trip set out in the schedule.
Trip departure times are often delayed but with just one click you can select a new departure time and the Scheduler automatically adjusts all the Rest and Work times. One more click and the Schdule is automatically printed out for the driver or filing. The system requirement is Microsoft Excell 2003 or later.
SAMS is a leader in providing effective practical Fatigue Management Accreditation Programs for BFM and AFM. We also provide a Strandard Hrs Fatigue Management Program which helps ensure that Standard Hrs operators, as well as BFM and AFM operators, comply with the law and have a Reasonable Steps Defence.
SAMS established the first 4 AFM (Advanced Fatigue Management) programs in South Australia in November 2010 and we have established BFM and even Standard Hours programs for many operators. Our programs are so well regarded by the authorities and Auditors that they are processed quickly because we have worked closely with the authorities in developing our programs and they are confident in and trust our work.
We provide the fatigue Management Programs as either CORE programs, that the client then modifies to suit their needs, or we provide the COMPLETE program which we tailor to meet client's needs. This is the most cost-effective option, as we are expert in this and can do it far more quickly and efficiently.
We can merge our Fatigue Management programs with NHVAS Mass/Maintenance programs and/or with OH&S programs and we can incorporate a Speed Policy as well. We provide major discounts for multiple combined programs. Our programs are well regarded by Auditors and the Transport Agencies.
All Truck operators are required under the Speed Compliance Regulations to have a documented Speed Compliance Policy. A $10,000 fine applies if you do not have a Speed Compliance policy, which must be more than a throw away statement. The SAMS Speed Policy covers the requirements of the law, without being too complex and is designed to be able to be merged effectively with either NHVAS Mass/Maintenance or Fatigue Management Programs.
SAMS NHVAS Mass and Maintenance Management Accreditation Programs are tried and proven as effective and practical programs that work well for the operator. We provide the NHVAS Programs as either CORE programs that the client then modifies to suit their needs or we provide the COMPLETE program which we tailor to meet the client's needs. This is the most cost-effective option as we are expert in this and can do it far more quickly and efficiently.
We can merge our NHVAS Management programs with with the Fatigue Management programs and/or with OH&S and we can incorporate a Speed Policy as well. We provide major discounts for multiple combined programs. Our programs are well regarded by Auditors and the Transport Agencies.
