Fatigue Management
Fatigue Database: Easy Management of Compliance with the Fatigue & Speed Laws.
The Fatigue Management laws for truck operations are so complex, the only effective and safe way to ensure compliance is to use a database designed by people with expert knowledge of the fatigue laws. SAMS Fatigue Database, developed by Steve Shearer, helps you manage your operations and drivers' fatigue whilst meeting your legal obligations and minimising your risk of $1,000 to $50,000 fines. It helps you easily and efficiently establish a Reasonable Steps Defence, based on comprehensive compliance checking and records, with just a fraction of the time and effort that doing it manually requires

The SAMS Fatigue Database deals with Standard Hrs, BFM and AFM Options and Solo or Two-Up driving and enables you to:
- PROVE that your Schedules are legal (under Fatigue and Speed laws) - Scheduler’s Duty Of care (must provide schedules that you KNOW comply)
- PROVE you check that drivers comply - the General Duty of Care (Not to allow or require driving whilst impaired by fatigue)
- PROVE you check that drivers’ MEDICALS and LICENCES are CURRENT – tells you whose licences and medicals are due NEXT month
- PROVE that driver’s Fatigue Training is CURRENT (TLIF1007C and Induction) - warns you if BFM/AFM work is allocated to untrained drivers
- PROVE that you track compliance – provides range of Reports on compliance of the business and any or all drivers for any period.
The SAMS Fatigue Database also provides MAJOR BUSINESS OPERATIONAL BENEFITS AND TOOLS. With just 4 simple steps/clicks it:
- Helps you Schedule drivers by selecting from a list of drivers who can legally do the work required
- Print Out Schedules or Work Diary records for drivers, including a summary confirming that it complies
- Provides PREDICTIVE Planning tools:
a. Calculates and shows when each driver can next start work and how many Work hours they’ll have available under Standard and BFM
b. Lets you check how many Standard or BFM Hours a driver will have at any date that you nominate
- Lets you Create and re-use STANDARD TRIPS – just a couple of clicks applies a Standard Trip to a Driver’s day
a.you can even alter the start time of a Standard Trip and everything moves forward.
- Links Truck/Fleet Number to a Driver’s Trip record – makes finding trip records following infringements etc easy
- Maintains all Leave Records (from Annual Leave to Workers Comp etc)
a.Warns Ops Managers if a driver will START leave within 7 days or is on leave and says when they'll return.
- Maintains all Medical Records and details of any restrictions and review dates etc
- Maintains all Training Records, including identified training requirements and when they’ve been met
- Maintain Driver and/or business Compliance history - records and tracks compliance issues and any corrective action taken or outstanding.
ALL THIS JUST TAKES JUST A FEW SIMPLE CLICKS and removes the stress and drama of managing under the Fatigue and Speed laws and helps protect your Business and drivers from major fines that can be from $1000 to $10,000 (for individuals) and even $50,000 (for corporations).
Just 4 Simple Steps/Clicks: To enter a Work Diary/Schedule and do full compliance Check you just need to use the following 4 fields in the top left corner of the database screen, shown below to:
- Enter Date (automatic after day 1*)
- SELECT Standard, BFM or AFM
- SELECT Shift type
- SELECT a Start Time
- CLICK on the Short Rest periods
* If you keep continuous records per driver, including rest days, the date is automatically entered after first day but you can overwrite it.
As soon as you enter a Date, the Code calculates the Hours Worked and the Night-Long hrs in the prior 7 to 28 days AND shows the hours still available under the 7, 14 and 28 day rules to help you plan and ensure tha the driver has the hrs available for the job. It even warns you if the driver has LESS than one day’s worth of time AND if you have exceeded the legal limits.
Then the Code does all the work in a flash and comprehensively checks for legal compliance automatically AND:
Indicates Breaches or Compliance and it even shows you where the Breaches are.
Nearly all the fields are automatic as the program does all the work for you, quickly, easily and very cost-effectively – except for the four fields above and clicking to select the 15 minute Rest times in the Rest Column. The Fatigue Database provides you with a simple but comprehensive Fatigue Management tool that, in addtion to the above benefits, provides:
- Comprehensive records and Standard Reports, including on:
i. Compliance per Driver and ALL Drivers in any period (see eg below);
ii. Overall Compliance stats for the business in any period (see eg below);
iii. Medicals and Licences Due NEXT Month – these reports will print out automatically in the middle of the month for next month OR whenever you want;
iv. List of drivers using specified trucks – this can help you easily identify drivers involved in an infringement and then simply print out their records;
v. Drivers Work Summary for any period; vi. Outstanding Training; and vii. Whatever you need whenever you need it.
- Predictive Planning: Continually tracks When Driver is Next Able to Work and How Many Hours Work they will have available.i. You can even enter a date and then see what Hrs the Driver will have Available under Standard, BFM or AFM Hours Options.
At just $1950 ($2145 incl GST) and $110 per additional site licence, the Fatigue Database is exceptional value because it will:
- Save you an enormous amount of time – checking Work Diaries manually is time consuming and risky
- Take the stress out of keeping track of your drivers’ compliance with Work and Rest Hours;
- Make it much easier for you to demonstrate that you have taken Reasonable Steps by:
- Meeting your Legal Duty of Care as a Scheduler – to check that schedules are legal BEFORE giving them to drivers;
- Meeting your General Legal Duty of Care – to ensure that drivers do not drive whilst impaired by fatigue
- Keeping track of drivers’ medicals and licence renewals
- Checking that Schedules do not require speeding
- Checking that drivers are not speeding by recording and checking their Work Diaries. /li>
The new Fatigue Management laws are so complex and the risks of errors through manual record keeping and compliance checking are so high that more and more operators are adopting tools and systems to ensure that they get it right and that they have a Reasonable Steps Defence. This applies equally to the brand new Speed reforms that commence in South Australia in February 2010.
Errors and Breaches Will Happen – BUT will Your Business be Protected?
No transport business is perfect and no driver groups is error-free, so there will be Fatigue and Speed breaches and the fines for each breach can easily be $1000 (and up to 10,000 for individuals) and even up to $50,000 for corporations. The key for your business in avoiding such fines is to ensure that YOU:
- Avoid the breaches in the first place – eg by planning legal schedules and monitoring drivers’ compliance; and
- Can PROVE, with credible documented evidence, that they took All Reasonable Steps;
That’s why SAMS has invested over 700 hours in developing the Fatigue Database.
To provide even greater support for operators, we are now working with other technical service providers like JAIX and MTData to help them interface their existing software and systems with the Fatigue Database.
Operators whose Training, Health and Leave record-keeping systems are not as efficient as they’d like are taking advantage of fact that these records are integrated into the SAMS Fatigue Database.
We are also currently developing and SQL version of the Fatigue Database to meet the high-volume data needs of the largest truck operators
